hi may question lang po ako bumili kasi ako ng house and they required to submit an SPA can i place other name in my family to my spa kasi seperated na kami ng husband ko if sya ang ilalagay ko dto mgkakaron sya ng rights sa mga idinideclare ng spa to the fact n wala nman n dapat xang karapatan dun.what should i do pls help.thanks

If legal separation the spouses shall have no right to the properties acquired after the decree of LS is issued. If separation de facto only, then the spouses still have the right to the properties.

But yes, you may nominate or appoint any person as your attorney-in-fact for it has no effect as to ownership over that property.

HI,ask ko lng po,pumanaw n lolo nmin,ang lola ang buhay pa,pero bngay ng lolo nmin ang spa s tita namin,ngaun,she had it wthout knowledge of our parents and one sistr ng papa ko,wthout proof alm namin at ng magkaptid na pilit at gawa ng tita namin ang plano n mgkaroon sya ng SPA.,ngaun,ano po ba ang power ng spa?gano kalawak to?at wala n bng karapatan ang 2 nyang kapatid para humabol s mga ari-arian?ang gsto lng nmn ng papa ko ay mapakinabangan ng lola ko habang buhay ung pera nya,kya lng may takot ang lola ko n ipakansela,..ano po ang gagawin nmin?pls help po,..tnks..

may expiration po ba ang SPA? pwede po bang ipawalang bisa ang SPA na hindi nalalaman ng nagpapirma sa akin ng irrevocable-SPA?

Sir, anu po ilalagay kapag parang representative lang po. For maynilad connection po kase, matanda na po kase ang lolo ko kaya parang ang nanay ko po ang magpapa install, yet sa lola’t lolo ko po ang property. thanks thanks :)

Hi!

Sir, I would just like to ask about a SPA we don’t remember signing and is now used against us.Ganito po kasi nangyari, we sold our 1.2hectars to 3 different people. Ang isa, 600 sq.mtrs,ang isa 1 hectar sa isang developer, thn 1000 sq.mtrs sa last buyer.. but the 1 who bought the 1 hec loaned the whole 1.2 sa bank using the said SPA daw kasi nkuha nya ang mother title.now na remata ang whole 1.2 hec. Now up to what extent po ba ang power ng SPA? how can we disprove the SPA na hindi talaga kami pumirma? Pls. shed a light on this.. Thank u & God bless!

good evening po ask lng po ako ng advice sa inyo po,kasi po ng apply po ako pa dubai as a lady cleaners tapos nkapgdown na po ako ng 40,000 po tapos umabot ng isang taon di parin dumating visa kaya ko nalang po kenancel tapos hinihingi ko ung pera na down payment ko till now di parin binigay tatlong taon na po.ano po kaya dapat kung gawin po.makukuha ko po ba kaya pera ko may habol po ba ako?thanks

good afternoon po, may pinagkakautangan po ako, na mayroon attorney, subalit namatay po ito, may karapatan po ba na maghabla ang asawat anak sa akin, kung di nakapag-iwan ng SPA sa kanila, nagharap po kami sa barangay para pag-usapan kung kelan at paano babayaran, sa pangalawang paghaharap hindi po naging magnda usapan, dahil hindi sila pumayag sa aking pakiusap, kung kayat sinabi ng tagabarangay na sa pangalwang paghaharap ay magbibigay sila ng certification file action? tama po ba ito? kahit wala silang hawak na SPA, at ang barangay tama din po bang magbigay sila kahit nakikiusap ako na magbigay pa ng ia pang pagkakataon, dahil po ang pagkakaalam ko ay sa pangatlong paghaharap at di nagkasundo saka lang sila pdeng mag-issue ng certification to file action?

Pwede mag habla ang heirs o tagapagmana ng namatay (e.g. asawa, anak o magulang kung walang asawa at/o anak). Kapag namatay ang tao, binibigyan ng batas ng personality ang “estate” ng namatay kaya hindi kailangan ng SPA. Estate ang tawag sa mga naiwang ari-arian niya. Kapag hindi kayo nag kasundo sa brgy. magbibigay ng certificate to file action ang lupon at maari nang maghabla ang heirs sa korte.

hi! good morning po. i would like to ask your help if you have a template that i can use. i bought a car on my relative here in the states, its a car loan that i’m paying it in the bank here in the states. i would like to ask the bank if how much do i still need to pay but unfortunately it still in the name of my relative. so the bank don’t give me an authority to transact on the said car loan. the bank ask me to have an SPA, can you help me about this. my relative have been in the Philippines already, so i will ask them to give me an SPA together with a copy of her passport. Hope that you could help me about it. Thank you

hi, you can use the format here and just insert that your relatives are authorizing you to transact in the loan account you are referring. also insert that they are authorizing you to secure the certificate of registration of the car after full payment. Sa US kasi yan, i dont know how they do things there, but here, you don’t need SPA to pay a loan kasi pera yan, tatanggapin ng bangko yan. But you need an SPA from the owner of the car/debtor to get from the bank the documents such as the release of mortgage and the OR/CR of the car.

Unang tanong. me karapatan po ba ang mga apo ng tunay na may ari ng lupa na patay na. Paano po ba ang hatian ng sharing sa bentahan nito.
Ikalawang tanong. Ang lupa po ay naibenta ng isa sa anak ng may-ari na falsified ang document. Makapag protest po ba ang ibang miyembro ng mga kapatid para mapa walang bisa ang bentahan nito? Pls reply salamat.

Ang maghahati sa lupa ng namatay ay ang mga anak at asawa. Kung patay na ang asawa, mga anak na lang. kung patay na ang isa sa mga anak, ang anak ng anak or apo. Pwede mo pa-nullify sa korte ang bentahan ng lupa at ibigay ang pag-aari ng lupa sa tamang tagapagmana.
